At the end of May 2016 the Town Society objected the proposals for a hot food Take-Away at 81 Garrick Close, along the following lines:-
- There’s no indication of the days/hours of operation for this business – noise late at night would be un-welcome in such a high density residential setting (extraction fan in operation, car doors slamming, people talking loudly).
- The noise from the extraction fan I fear might be more of a nuisance perhaps than the smells – according to the plans it appears to have odour neutralising “thingamabobs” included in the extraction process. Smells will of course be largely unavoidable if a door or window of the premises is opened, particularly in hot weather.
- Customers rubbish will no doubt be an issue – there should be adequate provision for collection of customers rubbish outside the premises. The take away owners & staff should be vigilant about clearing any rubbish that has not been placed in the appropriate receptacle.
- Where will their industrial dustbins be stored (out of sight, we hope) not on the road taking up precious parking spaces or on the pavement – adequate provision for their food waste & other rubbish must be made to ensure that it is not on view.
- The proposed steel chimney at the side, which will be clearly visible from front of premises is extremely industrial looking & unsightly in this residential area – can it be routed inside the premises & come out through the roof or if outside then brick clad like a household chimney or moved to be out of sight?
Quite rightly there were many objections from local residents and the proposal was refused by Spelthorne Borough Council on the following grounds:-
- The proposed change of use to a takeaway in this location, is considered to have a harmful impact on neighbouring properties in terms of noise, disturbance and odours and insufficient information has been submitted in order to overcome the Council’s concerns. The proposal therefore would have an unacceptable impact on the amenity of the neighbouring properties contrary to Policy EN11 of the Core Strategy and Policies DPD 2009.
- The proposed ducting as a result of its scale and location would appear visually obtrusive and out of character in the street scene contrary to Policy EN1 and the Core Strategy and Policies DPD 2009.
The Applicant has now made an appeal to the Secretary of State and although your previous objection will be seen by the inspector it always strengthens the cause if you write again. Letters must be sent in triplicate, quoting reference APP/Z3635/W/16/3158714 to arrive by 29 November 2016 at the latest, addressed to :-
